The Tribal Self-Governance Negotiation Cooperative Agreement Program, administered by the Indian Health Service (IHS), supports federally recognized Indian Tribes and Tribal organizations in preparing for and participating in negotiations to assume control over health care programs, services, functions, and activities (PSFAs) that the IHS would otherwise provide. Through the Tribal Self-Governance Program (TSGP), participating Tribes gain the flexibility to tailor health care delivery to best meet the needs of their communities. Tribes may choose to receive health care services directly from IHS, contract with IHS to administer individual programs and services under Title I Self-Determination Contracting, or compact with IHS to assume control over health care programs under Title V Self-Governance Compacting. These options may be combined based on a Tribe’s needs and circumstances.
The programme provides financial assistance to help Tribes cover the costs associated with preparing for and engaging in negotiations with IHS.
Eligible applicants include the following:
An Indian Tribe, as defined by 25 U.S.C. 1603(14), means any Indian Tribe, band, nation, or other organized group or community, including any Alaska Native village or group, or regional or village corporation, as defined in or established pursuant to the Alaska Native Claims Settlement Act (85 Stat. 688) [43 U.S.C. 1601 et seq.], which is recognized as eligible for the special programs and services provided by the United States to Indians because of their status as Indians.
A Tribal organization, as defined by 25 U.S.C. 1603(26) and section 4 of the Indian Self-Determination and Education Assistance Act (25 U.S.C. 5304(l)), means the recognized governing body of any Indian Tribe; any legally established organization of Indians which is controlled, sanctioned, or chartered by such governing body or which is democratically elected by the adult members of the Indian community to be served by such organization and which includes the maximum participation of Indians in all phases of its activities. Applicants must submit letters of support or Tribal Resolutions from the Tribes that will be served.
